1. Acceptance of Terms
Welcome to FaceMixer ("the App" or "we"). FaceMixer is a local AI face swap application that lets you swap faces in photos and videos, including multi-face creations and template-based content.
By downloading, installing, accessing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to any part of these Terms, please stop using the App immediately.
2. Description of Service
The App provides the following core services (subject to the actual released version):
- Photo Face Swap: swap faces in photos using locally processed AI;
- Video Face Swap: swap faces in video clips on your device;
- Multi-Face Swap: detect multiple faces in a photo and swap selected faces;
- Template Creations: use curated templates with your selected avatar;
- Avatar Library: save and manage face avatars locally on your device;
- Premium Features: subscriptions, credits, and PRO entitlements for advanced capabilities.
Personal photos and videos you select are processed locally on your device by default. Templates and models may be downloaded from our servers. We reserve the right to modify, suspend, or discontinue any part of the service at any time with reasonable notice where practicable.
3. Eligibility
You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the App. If you are under 18 (or the age of majority in your jurisdiction), you should read these Terms and use the App under parental or guardian supervision.
You are responsible for all activities conducted through your device and account when using the App.
4. Face Processing Consent
Before face swap processing begins, the App will present a clear notice that face data from your selected images or videos will be processed. You must acknowledge this notice before creation can proceed.
By proceeding with face swap, you confirm that:
- You have the right to use the photos, videos, and faces you select;
- You have obtained any necessary consent from individuals whose faces appear in your content;
- You understand that face data is processed locally on your device for the current creation task.
5. Subscriptions, Credits, and Payments
The App operates on a Freemium model. Certain features require a subscription, credit purchase, or PRO entitlement.
- Subscriptions and purchases are processed through Google Play and are subject to Google Play's terms;
- Subscriptions auto-renew unless canceled at least 24 hours before the end of the current billing period. Manage subscriptions in your Google Play account settings;
- Some features use a credit-based system. Credits are non-transferable and have no cash value. Unused credits may expire according to terms displayed in the App;
- Prices may vary by region and promotional offers. We reserve the right to change pricing with notice where required;
- Except as required by law, subscription fees and used credits are generally non-refundable. Refund requests should be submitted through Google Play.
6. Acceptable Use and Content Guidelines
You agree not to use the App to create, upload, or share content that:
- Is sexually explicit, pornographic, or otherwise inappropriate;
- Is hateful, discriminatory, harassing, or defamatory;
- Violates others' privacy, publicity rights, or intellectual property;
- Promotes illegal activities, violence, or fraud;
- Constitutes deepfakes or misleading content intended to deceive others;
- Involves minors without proper consent from a parent or legal guardian;
- Includes non-consensual intimate images or impersonation without disclosure;
- Attempts to bypass NSFW screening, subscription limits, or credit verification.
You must not reverse engineer, decompile, or attempt to extract the App's source code, AI models, or underlying technology.
7. User Content and Ownership
7.1 Your Content
You retain ownership of the original photos and videos you upload or select in FaceMixer. By using our service, you grant us a limited license to process your content locally on your device for the purpose of providing face swap services.
7.2 Generated Content
Face-swapped results created using our AI technology may be used by you for personal, non-commercial purposes in accordance with these Terms and applicable laws.
7.3 Prohibited Use of Generated Content
You may not use generated content to impersonate others, create misleading or deceptive content, or for commercial purposes without proper disclosure that the content was created using AI face swap technology.
8. AI Technology and Disclaimers
Face swap results are generated by AI technology and may not be 100% accurate or realistic. Results may vary depending on input image quality, lighting, angles, and other factors.
We do not guarantee that the service will meet your specific requirements or that results will be satisfactory for your intended use. AI-generated content should be used responsibly and with appropriate disclosure when shared publicly.
9. Intellectual Property
The App and its software, UI design, icons, AI models, templates, documentation, and other content are owned by us or our licensors and protected by copyright, trademark, and other intellectual property laws.
You may not copy, modify, distribute, sell, or rent any part of the App without our written permission.
10. Privacy
We value your privacy. For details on how we collect, use, and protect your personal information — including face data — please see our Privacy Policy. These Terms and the Privacy Policy together form the complete agreement between you and us.
11. Device Permissions
The App may request access to your device's camera, photo library, storage, and network to provide face swap services, save results, download templates and models, and verify subscriptions. You can control these permissions through your device settings.
12. Termination and Account Deletion
You may stop using the service at any time by uninstalling the App. You may delete your account through the App settings or our account deletion page.
If you violate these Terms or engage in conduct that may harm the App, other users, or third parties, we may suspend or terminate your access without notice and without refund (except as required by law).
13. Disclaimer of Warranties
The App is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we make no warranties regarding continuous availability, error-free operation, or fitness for your particular needs.
We are not liable for service interruptions or feature limitations caused by device compatibility, insufficient storage, model download failures, system permission restrictions, or other factors beyond our reasonable control.
14. Limitation of Liability
To the fullest extent permitted by law, we and our affiliates, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from use or inability to use the App, including loss of data, loss of profits, or business interruption.
Our total liability to you for any claims related to these Terms or the App shall not exceed the amount you paid us in the 12 months preceding the claim, or USD $50, whichever is greater.
15. Indemnification
You agree to indemnify and hold harmless FaceMixer and its developers from any claims, damages, or expenses arising from your use of the service, content you create or share, violation of these Terms, or infringement of third-party rights.
16. Changes to Terms
We may revise these Terms from time to time. Updated Terms will be posted on this page with a revised effective date. For material changes, we will notify you through in-app notices or other appropriate means. Continued use of the App constitutes acceptance of the revised Terms.
17. Governing Law and Disputes
These Terms are governed by the laws of the People's Republic of China (excluding conflict of law rules), unless mandatory laws in your jurisdiction provide otherwise.
Disputes arising from these Terms or the App should first be resolved through good-faith negotiation. If negotiation fails, either party may bring a lawsuit in a court of competent jurisdiction at our location.
